An update to that story included word from the National Highway Traffic Safety Administration that it was considering launching a federal investigation into potential delays by the automaker in notifying owners about the problem. Now comes news that parent company Toyota will pay a hefty $17.35 million in fines for delaying its recall of the 2010 Lexus RX 350 and RX 450h. According to The Detroit News , the Japanese automaker is being forced to pay the maximum fine for delaying recalls – and this isn’t the first time. In fact, this is the fourth time since 2010 that Toyota has been required to do so, including paying $48.8M in civil penalties in 2010 for failing to recall vehicles in a timely manner – in three separate campaigns. In addition to the fines, Toyota has agreed to restructure the way it handles quality control and review “safety-related issues.” Though the Japanese automaker has not admitted any wrongdoing, Toyota has agreed to meet with NHTSA for six months on the matter and may extend the meetings another six months. US Transportation Secretary Ray LaHood says he is counting on Toyota to improve its ability to address such safety issues: “With today’s announcement, I expect Toyota to rigorously reinforce its commitment to adhering to the United States safety regulations,” he said in a statement. According to the report, Toyota has recalled more vehicles than any other automaker so far this year – 5.3 million in 13 separate campaigns – putting it about two million units ahead of second-place Honda . This latest fine is a drop in the bucket compared to Toyota’s expected global profits of $9.7 billion by the end of March, 2013. That said, Congress has already agreed to a new fine that will push the maximum penalty for delayed recalls up to $35 million.

If the National Highway Traffic Safety Administration gets its way, that already high figure will swell to a full 100 percent in short order. Such automotive black boxes have been in existence since the 1990s, and all current Ford , General Motors , Mazda and Toyota vehicles are so equipped. NHTSA has been attempting to make these data recorders mandatory for automakers, and according to The Detroit News, the White House Office of Management Budget has just finished reviewing the proposal, clearing the way. Now NHTSA is expected to draft new legislation to make the boxes a requirement. One problem with current black boxes is that there’s no set of standards for automakers to follow when creating what bits of data are recorded, and for how long or in what format it is stored. In other words, one automaker’s box is probably not compatible with its competitors. Expect all these issues to be worked out “in the coming months,” according to NHTSA spokeswoman Lynda Tran. According to an Automotive News report, Toyota filed a complaint with the U.S. District Court in Lexington, Kentucky late last week. The complaint was filed against former IT contractor Ibrahimshah Shahulhameed, who Toyota says was fired on August 23. According to the filing, Toyota indicates Shahulhameed logged on to its system the evening of his firing and downloaded and printed trade secrets. One result of the filing is that Toyota has acquired a restraining order against Shahulhameed, prohibiting him from leaving the United States or disseminating the information that Toyota says is ill-gotten company property. The specific area that was hacked was ToyotaSupplier.com, a site where the automaker’s suppliers exchange highly sensitive information with Toyota about both current and future products. Toyota states that it will continue to investigate the security breach and do not yet know exactly what has happened with the confidential information. There is the possibility that it may have changed hands, but according to a Toyota manufacturing spokesman, “It’s too early to speculate on what-if’s.” According to the court documents, Shahulhameed is an Indian citizen who was living in Georgetown, Kentucky, and was apparently about to leave for his native India. According to the Kaizen Factor blog, Toyota has filed numerous trademark applications in both the United States and Canada for various spindle grille designs. The main differences in the designs are the inserts, either a zig-zag mesh like the current F Sport models of the CT , IS , GS , RX and LS , or a horizontal pattern like the non-F Sport models. But there’s also a new “vertical bar” design revealed by the filings, which the report speculates may be applied to the next-generation IS. Toyota has also filed paperwork to trademark the basic spindle outline with no insert, according to the report.
